Surveying, being one of the land management procedures, includes a certain set of works. They are carried out to restore or consolidate, as well as to establish limits, determine the location and area of ​​territories allocated to the property of citizens. Upon completion of these works, a boundary plan of the boundaries of the land plot is drawn up. This technical document is drawn up on the basis of the cadastral scheme or an extract from it about the corresponding allotment. Consider further how a land survey plan is drawn up. The boundary plan of the land plot is necessary to determine the exact coordinates of the allocated territory on the federal cadastral map. At the same time, it is possible to determine the limits of the allotment directly on the ground. All information obtained in the process of performing work is recorded in the boundary plan. The formation of a land plot without this will be conditional. In this case, it cannot be outlined graphically. Accordingly, it cannot be entered into the register. If the owner does not have a land survey plan, the owner will not be able to obtain a cadastral passport. Without it, in turn, it is impossible to register the allotment in Rosreestr, which does not allow any transactions to be made.

Design specifics

Only competent organizations have the right to draw up a boundary plan for a land plot. They must be employed by cadastral engineers. If the boundary plan of the land plot is drawn up in electronic form, it, like a paper copy, must be certified by the signature and seal of the specialist conducting the work. The document includes several parts.

Sample land survey plan: graphic block

This part reflects information about a specific territory allocated for possession. The data is in the cadastral documentation or an extract from the scheme. In the graphic part, the boundaries of one or several sections are depicted or specified / restored. In the same section, access to the formed allotments should be shown. This may be an entrance, a passage from those areas that are considered common. Accesses must be displayed even if they are established through an easement.

Text part

This block of the boundary plan contains the information necessary for entering into the cadastre. The volume in which the necessary information must be submitted is determined by the authorized body for legal regulation in the field of cadastral relations. In a number of cases stipulated by the legislation, acts of coordination of the location of the boundaries of the relevant land area should be included in the land survey plans. All necessary work is paid by the person who orders the documentation. The cost of the boundary plan will depend on the area of ​​the plot, the form of ownership, the amount of data that will be entered into the cadastre, as well as the need for additional services by an engineer.

When is a document required?

As mentioned above, a boundary plan is needed to make various transactions with land. In particular, it can be rent, sale, donation, exchange, legal registration of the owner's rights, association and division, and so on. Without a document, you can not make any transactions with the land. Engineers restore the boundaries of the allocated territories in case of disputes, as well as the loss of appropriate signs on the ground. Surveying is also carried out when allocating, dividing or merging plots.

To carry out land surveying with the subsequent drawing up of a plan, the cadastral engineer carries out a number of mandatory measures. The scope of work usually includes:

Coordination with stakeholders

As mentioned above, the cadastral engineer sends notifications to all interested parties. The result of agreeing on the location of the boundaries of the site is drawn up by a specialist in the form of a special act on the reverse side of the graphic part of the boundary plan. In the event of disputes over the definition of the boundaries of the territories, the owner, who does not agree with the option proposed by the engineer, has the right to go to court and file an appropriate claim. Based on the situation, he can provide his scheme for establishing boundaries. At the same time, he must justify his position. If necessary, the court may order a second examination.

Finally

As a rule, in practice there are no difficulties with drawing up a boundary plan if the neighbors reach an agreement. The duration of the engineer's work will depend on the complexity of the situation, the characteristics of the territory, the number of issues that he must resolve at the request of the customer. In any case, every owner of a land plot should have a boundary plan, so that later it can be registered without any problems.

Article 14 federal law No. the boundary plan is indicated as the basis for conducting cadastral registration and registration actions with land real estate. In addition to determining the initial parameters of the newly formed area, the preparation of a boundary plan is necessary for any changes in characteristics (section and section, association, etc.).

The general rules for drawing up boundary plans are fixed in Article 22 of Federal Law No. The document consists of a text and a graphic part, it can be made in written or electronic form.

The boundary plan is made on the basis of the cadastral plan of the territory or an extract from the state register, and its content includes the following information about the land allotment:

  • data on a newly formed land unit, which will be the basis for conducting cadastral registration;
  • information about the parts of the site, subject to registration in the cadastral authorities;
  • new information about the characteristics of the land allotment obtained as a result of cadastral work.

In cases stipulated by legislative acts, the cadastral work in relation to the site ends with the coordination of its boundaries with the owners of adjacent allotments. The act of coordination is included in the content of the boundary plan, and if there are objections between the owners of neighboring objects, the dispute can be settled in court.

Expert comment. The boundary plan is made by a cadastral engineer on the basis of a contract concluded with the owner of the site. The law establishes the priority of the electronic form of the boundary plan, and if the customer needs a written document, such a condition is included in the contract. When choosing a cadastral engineer, you need to make sure that he has a qualification certificate and an SRO permit, this information can be checked through the federal database of Rosreestr.

Boundary plan form

The requirements for filling out all the items and the column of the boundary plan form are regulated by Order No. 921. The same normative act approved the composition of the information that the cadastral engineer must indicate in the form of a land survey plan. Regardless of the type of cadastral work, the following sections must be included in the land survey plan:

  • general information about the work performed by the cadastral engineer;
  • initial data;
  • data on performed calculations and measurements;
  • layout of the object;
  • drawing.

If these works are related to the merging of two sites into a single object, the obligatory points of the boundary plan will include information about newly formed allotments and data on providing access to them.

Section 1. General information about cadastral work

When filling out section 1 of the boundary plan, the information included by the parties in the contract is used. The following columns are filled in the text form:

  • “The land survey plan was prepared as a result of cadastral work in connection with…” - the reason why the right holder needs to conduct a survey of the site and fix its characteristics (for example, clarification of the location of the boundaries and area of ​​​​the object) is indicated;
  • “Purpose of cadastral work” (for example, if a plot is allocated on account of a share in the right to agricultural land);
  • "Information about the customer of cadastral works" - data are indicated individual or organizations acting as owners of the site, as well as information about the representative by proxy;
  • "Information about the cadastral engineer" - the personal data of the specialist are indicated; number of the qualification certificate; address information, as well as the date of preparation of the document.

If the cadastral engineer is an employee of the organization, the details of the legal entity are additionally indicated.

Expert comment. The cadastral engineer is responsible for the correctness and reliability of the calculations and measurements that will be recorded in the boundary plan. If technical or registry errors are identified during the cadastral registration, their correction will be carried out by the engineer who drew up the act.

Section 2. Initial data

Section 2 of the survey plan contains information about the documents submitted to the cadastral engineer, as well as a detailed description of the initial information for measurements. According to Order No. 921, section 2 contains the following columns:

  • the composition of the documents that were used in the preparation of the plan - an extract from, a certificate of entitlement (if it was issued before July 2016), an extract from the Unified State Register of Legal Entities for the customer-organization, etc.;
  • information about the geodetic basis - information about the points and the class of the geodetic network; and coordinate system, etc.;
  • information about the measuring instruments used by the cadastral engineer - the name of the device or equipment; details of the document on verification of equipment; data on approval of the type of measurements;
  • data on the presence of buildings, structures or objects of construction in progress on the surveyed site - the cadastral numbers of the land allotment and capital construction objects are indicated;
  • information about parts of the original or refined objects.

If the state register does not contain information on real estate objects located on the site, it is allowed to indicate previously assigned state registration numbers (for example, an inventory or account number).

Section 3. Information about the performed measurements and calculations

Section 3 of the boundary plan indicates the data obtained by the engineer during the performance of cadastral work. The accuracy of the information received will depend on the positive completion of the cadastral registration procedure, so the engineer indicates not only the final value of the boundary points or area, but also the method of measurement, the formula for calculating the error, etc.

In section 3, the cadastral engineer will fill in the following columns:

  • method for determining the coordinates of characteristic points of the boundaries - when establishing these points, the geodetic, cartometric, photogrammetric method, as well as the method of satellite geodetic measurements can be used;
  • the accuracy of determining the position of the points of the boundaries of the whole land object (plot and the formula for calculating the error);
  • the accuracy of determining the position of the boundary points for a part of the land allotment;
  • the accuracy of determining the area of ​​​​the object (indicated, information about the area and the formula for calculating the error);
  • the accuracy of determining the area for a part of the land allotment.

Expert comment. When performing cadastral work, an engineer can apply several methods for determining coordinates. In this case, section 3 specifies all the methods actually used by the engineer in surveying the site and calculating the data..

Additional sections of the text part of the boundary plan

The sections listed above are mandatory elements of the text part of the boundary plan, filled in for any type of cadastral work. However, Order No. 921 defines additional sections that may be included in the boundary plan for certain types of surveys:

  • information about the formed land plots (for example, if one or several independent units are allocated from the composition of the whole object);
  • information about the changed land plots (for example, if the amount of land shares is changed by agreement between the owners);
  • information about specified land plots;
  • information on providing access to the created or changed allotments;
  • data on parts of the site;
  • the conclusion of the cadastral engineer (for example, to justify the location of the specified boundaries, the engineer can refer in the conclusion to specific objects of artificial origin that fix the boundaries on the ground - the walls of buildings, concrete fences, etc.);
  • the act of coordinating the boundaries of the land allotment.

The need to fill in the listed additional sections is determined by the cadastral engineer based on the specifics of the assigned work.

Expert comment. When filling out the section with the act of agreeing on the boundaries, the engineer indicates one of the following options - the presence of an agreement with each owner of the adjacent plot; the presence of disagreements about the location of the borders; information about disputes. Among the ways to remove disagreements about the boundaries of the site, Order No. 921 highlights: the actual change in the location of the boundaries; consideration of the dispute in judicial institutions; adjudication of a dispute in arbitration.

Graphic part of the boundary plan

In addition to the text block, the boundary plan includes a graphical part - displaying the information received, calculations and measurements on diagrams and drawings. The composition of the mandatory sections of the graphic part of the boundary plan Order No. 921 includes a layout of the object and a drawing of the site or its parts. Additional sections of the graphic block that can be filled in when carrying out certain types of cadastral work include a scheme of geodetic constructions and outlines of the nodal points of the boundaries of the object.

Scheme of location of land plots

The graphic part of the boundary plan is drawn up simultaneously for all formed allotments or their parts. When clarifying the boundaries and area, the cadastral engineer conducts a graphical display of the boundaries of each specified area. The layout of the plots is made on the basis of information containing cartographic data, or using other cartographic material.

When filling out the specified section, the location of the site is displayed in graphical form relative to adjacent objects and the boundaries of the cadastral division, and the diagram indicates:

  • the boundaries of the object on which cadastral work was carried out, as well as the boundaries of adjacent allotments;
  • boundaries of municipalities or settlements;
  • borders of cadastral division;
  • boundaries of territorial zones, objects of cultural heritage, etc.

If a boundary plan is made during the formation and formation of a new object, the diagram will reflect lands or common areas.

Drawing of land plots and their parts

The drawing of the site or its parts is an obligatory element of the boundary plan. This block contains the following information:

  • the location of existing, new and ceasing characteristic boundary points;
  • parts of the boundaries of plots, as well as parts of objects;
  • designations of land plots and characteristic points of borders.

When transferring the specified information to the drawing, the cadastral engineer is obliged to use a scale that ensures the readability of the location of the characteristic points of the boundaries. The drawing field displays all formed or refined sections, as well as their parts. The layout of the drawing allows the use of callouts or frames on separate sheets, if necessary, to display individual boundary points.

If the boundary plan is drawn up to clarify the boundaries of the site, an approval certificate is drawn up on the back of the drawing. When filling out this act, it is mandatory to indicate the passport data of the right holders of related objects, or information about their representatives.
